Marbella Fairways Owners Club Rules and Regulations
 
Summary of Main Provisions

The following summary has no legal standing and may not be used as a substitute for the complete texts to which it refers. A Copy of the Constitution and Deed of Trust may be obtained by written application to the Club Secretary enclosing a cheque for £2.
 
Name of Club : The Marbella Fairways Owners Club
Location of Club : At Las Pergolas, Aloha Golf Course, Marbella, Spain or at any place the members may nominate.
Object of Club : a) Non-profit making
b) To secure its members exclusive rights of occupation of the Villas
Members : The Villa owners.
Trustee : The properties, and the Club Constitution are held in trust by the Club's trustees, Curzon Secretaries and Trustees Ltd.
Life of the Club : The Club will continue until 2030 when it will be wound up, the Villas sold, and the proceeds shared by the Club's members.
Club Committee : Five Club members, elected at General Meetings (AGM) and serving terms of 3 years each. Up to 2 additional people may be co-opted by the committee, with their co-option to be approved at the next Annual General meeting.
Members' Duties : To pay their share of the annual costs of running the Club. To ensure that they and their guests comply with the Club's rules and regulations. Not to modify, change or damage any of the Villas or their contents. To keep the Club advised of any change of address.
Suspension or Termination of Membership : The Committee may suspend a member who is in serious breach of duty. It may terminate a membership if the breach is serious.
Non-payment of Management Fees : If a member fails to pay the annual management fees due, plus any charges for late payment, within six months of the due date (December 31st), The Committee may terminate the membership and transfer the ownership elsewhere without compensation.
Members' Rights : To elect or change the Committee at an AGM and to have exclusive use of the Villas and all the facilities and services at Las Pergolas during the week(s) of their ownership. To occupy the Villa (up to six persons).
Annual General Meeting : Held every year in the UK. Resolutions may be carried by a majority of owners (proxy votes allowed).
Annual Audit : The Committee is required to appoint independent auditors and put audited accounts before the membership at each AGM.
Law Applicable : The law of England.
The Deed of Trust : The Deed of Trust, which may only be varied with the consent of the Trustees, secures the Villas for the use of the owners and ensures that the Club's Constitution cannot be modified in any way which would be injurious to the Club or its members.
Club By-Laws : The Constitution sets out Regulations governing the use to which the Villas may be put.

Occupancy Regulations

Golf BallThe following Regulations shall apply to all members during their period of occupancy and to the guests and licensees and all other persons lawfully occupying any of the Villas at any time whether or not such person shall be a member of the Club and for the purposes of these Regulations the expression "Member" shall include all such guests, licensees and other persons.

No member shall :-
  1. Use any of the Villas for any purpose whatsoever other than as a private holiday home in the occupation of no more than six persons.
  2. Use any of the Villas for any other purpose which might cause a nuisance or annoyance to other members or any owner occupier of any adjoining land.
  3. Use any of the Villas for any illegal or immoral purpose whatsoever or for the purposes for trade, business or profession.
  4. Cover or obstruct any of the windows of the Villa otherwise than with the curtains or blinds supplied in the Villa.
  5. Hang or expose anywhere outside any Villa, or in any position visible from outside the building (save in the small yard at the rear of the Villa), any washing or clothes or any posters, signs or advertisements of any kind whatsoever.
  6. Throw any dirt, rubbish, rags, oil or any other damaging material or refuse into the sinks, bath, lavatories or pipes of any Villa or the swimming pool.
  7. Throw any dirt, rubbish , rags or food out of any of the windows or doors of any of the Villas or allow any such things to be left anywhere in the grounds adjoining any of the Villas.
  8. Play any wireless, television set, gramophone, tape recorder or musical instrument, or any other similar equipment, or carry on any other activity in any Villa in such a way as to cause a nuisance or annoyance to any other member and in particular so as to be audible outside any Villa between the hours of 11.30pm and 9am.
  9. Shake or beat any carpets, dusters or other objects form the windows or doors of any Villa (save in the small yard at the rear of the Villa).
  10. Bring or keep any animal or bird in any Villa.
  11. Store or allow to remain in any Villa any inflammable or explosive substance.
All members shall at all times :-
  1. Comply with all arrangements from time to time made by the Club in relation to the disposal of refuse from any Villa.
  2. Comply at all times with any arrangements regarding safety from time to time made by the Club in relation to the use of the swimming pool.
  3. Comply at all times with any arrangements made by the Club in relation to the use of the tennis court.
  4. Comply at all times with the rules of the Aloha Golf Club in relation to the use of the clubhouse and any other facilities of the Aloha Golf Club and to observe at all times the rules of etiquette of Golf.

To use this chart, refer to your chosen week number from the top line, then read down this column and cross relate to the year column on the left.
 
Occupancy for a weekly period always runs form Saturday to Saturday, except for weeks 51 and 52.
 
An example - if you have bought week 40, your week of Time Ownership in 2006 will start on Saturday 7th October, but in 2009 it will start on Saturday 3rd October.
